BookifyLabs Terms of Service

Welcome to BookifyLabs. BookifyLabs is a software platform operated by LUMINA AI LLC, registered at Besarion Zhgenti N49, Tbilisi, Georgia. These Terms of Service ('Terms') govern your use of the BookifyLabs booking management platform and related services ('Service'). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.

1. About BookifyLabs

BookifyLabs is a software platform operated by LUMINA AI LLC ('LUMINA AI LLC', 'we', 'us', or 'our'). BookifyLabs provides online booking tools that allow businesses to create a digital booking page, manage appointments, and allow customers to schedule services online. BookifyLabs is a software service provider and does not participate in transactions between businesses and their customers. Businesses are solely responsible for the services they offer, the prices they charge, the information they provide to customers, and their relationships with their customers.

2. Account Registration

To use BookifyLabs, you must provide accurate and complete information about your business and maintain accurate account details. You are responsible for: maintaining the confidentiality of your account information; ensuring that information displayed to your customers is accurate; managing your employees and users who have access to your account; ensuring that your use of the Service complies with applicable laws and regulations. You are responsible for all activity conducted through your account.

3. Pricing and Payments

BookifyLabs charges a recurring subscription fee for continued access to the Service. Current pricing and available subscription plans are displayed in the BookifyLabs account dashboard before purchase. Pricing is the same globally regardless of your location. Customers may select and purchase a subscription directly through their BookifyLabs account dashboard. Subscriptions may be paid monthly or through advance payments covering multiple months. All payments for the Service are processed by Paddle.com Market Limited ('Paddle'), which acts as our authorized reseller and merchant of record for these transactions. This means Paddle, not LUMINA AI LLC, is the seller of record responsible for invoicing you, collecting payment, and, where applicable, collecting and remitting sales tax, VAT, or similar transaction taxes. By purchasing a subscription, you authorize Paddle to charge the selected payment method according to the subscription plan and billing terms presented at the time of purchase, and you agree to Paddle's applicable buyer terms in addition to these Terms.

4. Free Trial

BookifyLabs may offer a free trial period of one month to eligible new users, limited to once per person or business. To start a free trial, you will be asked to provide payment details in advance through Paddle. If you do not cancel before the end of the trial period, your payment method will automatically be charged for the first billing period of the subscription plan you selected, and your subscription will continue on a recurring basis until cancelled in accordance with Section 5. You may cancel during the trial period at any time through your account dashboard or by contacting us, and you will not be charged if you cancel before the trial ends. LUMINA AI LLC reserves the right to determine trial eligibility and to limit, modify, or discontinue the free trial offer at any time.

5. Subscription Period and Cancellation

BookifyLabs subscriptions are flexible and may be cancelled at any time. When a subscription is cancelled, the cancellation will take effect at the end of the customer's current paid billing period. The customer's account and access to the Service will remain active until the end of the current paid billing period. Cancelling a subscription does not entitle the customer to a refund or credit for any remaining unused portion of the current paid billing period, except where a refund is required by applicable law. If a customer has prepaid for multiple months, the subscription will remain active until the end of the paid subscription period. No refunds or credits will be provided for unused prepaid subscription time, except where required by applicable law. BookifyLabs does not require long-term contracts or minimum subscription commitments.

6. Refund Policy

Except where a refund is required by applicable law, all payments made for BookifyLabs subscriptions are non-refundable. BookifyLabs does not provide refunds or credits for completed, partially used, or unused portions of a paid subscription period, except where required by applicable law. Customers who cancel their subscription will continue to have access to the Service until the end of their current paid billing period. After the current paid period ends, the subscription will be cancelled and no further subscription payments will be charged. Conversation add-on packs for the AI assistant are one-time purchases and are also non-refundable, except where a refund is required by applicable law. Purchased conversations do not expire and remain associated with the account if the subscription is cancelled, but they can only be used while the account is on a plan that includes the AI assistant. Purchased conversations are not exchangeable for cash or account credit. Additional terms may be set out in the Refund & Cancellation Policy.

7. Service Availability

BookifyLabs aims to provide reliable service but cannot guarantee uninterrupted availability at all times. Temporary interruptions may occur due to: maintenance; updates; technical issues; third-party service failures; network or infrastructure failures; other circumstances outside our reasonable control. LUMINA AI LLC will make reasonable efforts to restore the Service as quickly as reasonably possible.

8. Acceptable Use

You agree not to: use the Service for illegal activities; attempt to disrupt, damage, or interfere with the platform; attempt to gain unauthorized access to accounts, systems, or data; access accounts belonging to other users without permission; upload harmful content or malicious software; use the Service to violate the rights of others; use the Service in a manner that could damage, disable, overburden, or impair the platform. LUMINA AI LLC may restrict, suspend, or terminate accounts involved in abuse, unauthorized activity, or illegal activity.

9. Customer Data

You retain ownership of the business information, customer information, and other content you provide to BookifyLabs. You grant LUMINA AI LLC permission to collect, store, process, and use this information as reasonably necessary to provide, maintain, secure, and improve the Service and as otherwise described in our Privacy Policy. You are responsible for ensuring that you have the necessary rights, permissions, and lawful basis to provide personal information to BookifyLabs and to use the Service to process such information. LUMINA AI LLC does not sell customer data.

10. Limitation of Liability

BookifyLabs is provided as a business software tool. LUMINA AI LLC does not guarantee that use of the Service will result in increased revenue, customers, bookings, or other particular business results. To the extent permitted by applicable law, LUMINA AI LLC is not responsible for: missed appointments caused by incorrect or incomplete customer or business information; business decisions made based on information provided through the Service; disputes between businesses and their customers; losses resulting from the misuse of the Service or account credentials; interruptions or failures caused by third-party services or circumstances outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

11. Changes to the Service or Terms

LUMINA AI LLC may update these Terms or modify, suspend, or discontinue features of the Service from time to time. Material changes to these Terms will be communicated when reasonably possible. If you continue to use the Service after updated Terms become effective, your continued use constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

12. Account Termination

You may stop using BookifyLabs and cancel your subscription at any time. LUMINA AI LLC may suspend or terminate accounts if: these Terms are violated; payments remain unpaid; the Service is abused or used improperly; the account is involved in unlawful or unauthorized activity; continued access to the account presents a security or operational risk. Where reasonably possible, LUMINA AI LLC will provide notice before suspension or termination. Where immediate action is reasonably necessary to protect the Service, users, or third parties, suspension or termination may occur without prior notice.

13. Governing Law

These Terms are governed by, and will be construed in accordance with, the laws of Georgia, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Tbilisi, Georgia, except where applicable mandatory law provides otherwise for your protection.
